Hogwarts Legacy is not on board with the Switch 2 Upgrade Pack model. Instead, the Nintendo Store has slashed the game's price for owners of the Switch version. The Hogwarts Legacy Switch 2 release should feature improved performance and mouse control.

It's not an upgrade pack. It's a different game, albeit in digital form.

It's literally the exact same thing as an upgrade pack, except that people who have the physical Switch 1 version get screwed.

It's really not though. Upgrade packs are like DLC or patches that apply to Switch games. This Hogwarts for Switch 2 is a new game with a lot of new code. The Nintendo site explains the Upgrade Packs pretty well.

The end goals are the same, but supposedly, this game has more technical upgrades than you get with most Upgrade Packs, since the game was rebuilt with graphics closer to next gen systems.
