It seems they solved that problem already. It was fixed in version 1.1.1 I think.

What is this article talking about.  Dell has been selling i9 since day 1.  It's just that you have to get it loaded (32gb ram, 1tb hd, touch screen).  Now you will be able to mix and match.

For now, the top configuration of the XPS 15 9570 with a non-touch full HD display available in the US via Dell.com sports an Intel Core i7-8750H processor. However, Frank Azor has just confirmed that more setups will be available later this month, including one that features the i9-8950HK processor out of the box.
