There is nothing illegal about emulation or making dedicated handhelds for the purpose of emulation. The only "illegal" part is whether you download games which you do not own.

Besides, with games you cannot legally buy any more, there is a growing grey area on whether obtaining those games is illegal at all.

Please stop scaring people because in reality most people do not care, and these laws aren't even enforced.

The writer appears unaware that "portrait" orientation is vertical and "landscape" orientation is horizontal.

This device has the controls under the screen so it could be considered vertical.
